Welcome to GistCast. These Terms of Service ("Terms") govern your access to and use of the GistCast website and services (the "Service"). Please read these Terms carefully before using the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Description of Service

GistCast is a platform that allows users to create, customize, and share animated code gists. The Service includes tools for code highlighting, animation configuration, and public sharing of generated gists.

2. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Providing accurate and complete information when creating an account.

We reserve the right to suspend or terminate your account if any information provided is inaccurate or if you violate these Terms.

3. User Content and Intellectual Property

Your Content

You retain all ownership rights to the code and content you upload or create using the Service ("User Content"). By posting User Content on GistCast, you grant us a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, and display such content solely for the purpose of providing and improving the Service.

GistCast Intellectual Property

The Service, including its interface, design, logos, and underlying technology, is the property of GistCast and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

4. Acceptable Use

You agree not to use the Service to:

  • Upload or share content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
  • Infringe upon the intellectual property rights of others.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Use the Service for any automated or high-volume purposes (e.g., scraping, botting) without authorization.
  • Distribute malware or other harmful code.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GISTCAST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE, ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN, OR ANY CONTENT OBTAINED FROM THE SERVICE.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GistCast operates, without regard to its conflict of law provisions.
